5. Client Responsibilities
Clients are responsible for providing timely access to necessary materials, information, and account credentials required for us to deliver our services effectively. Failure to provide such access may result in delays, for which we are not liable.
Clients must also comply with the terms of service of any third-party platforms (e.g., Facebook, Instagram, Twitter) used in conjunction with our services.
6. Service Delivery
We will make reasonable efforts to deliver the agreed-upon services within the specified timeline. However, timelines may be affected by factors beyond our control, including but not limited to, changes in social media platform algorithms, client delays in providing required information, or unforeseen technical issues.
We are not liable for any delays or performance issues resulting from such factors.
7. Intellectual Property
All content created by HUNGRY LAB LLC as part of our services, including but not limited to, graphics, text, and advertising copy, remains our intellectual property until full payment has been received. Upon full payment, ownership of the created content will transfer to the client, subject to the terms outlined in the service agreement.
Clients may not use any content provided by HUNGRY LAB LLC for purposes other than those explicitly agreed upon in the service agreement.
8. Confidentiality
We respect the confidentiality of our clients and are committed to protecting any personal or business information provided to us. We will not disclose any such information to third parties without the client’s consent, except as required by law.
9. Limitation of Liability
To the fullest extent permitted by law, HUNGRY LAB LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services. Our total liability to any client for any claim arising from or related to our services is limited to the amount paid by the client for the specific service in question.
10. Termination of Services
Either party may terminate the service agreement with written notice if the other party breaches any material term of these Service Conditions. Upon termination, the client will be responsible for any outstanding payments for services rendered up to the date of termination.
11. Governing Law
These Service Conditions are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts located in Albuquerque, New Mexico.
12. Changes to Service Conditions
We reserve the right to update or modify these Service Conditions at any time without prior notice. Any changes will be effective immediately upon posting on our website. Your continued use of our services following the posting of changes constitutes your acceptance of such changes.
